JOKES : WHEN YOU ARE ABOUT TO LOSE YOUR CASE – SEEK RECOURSE TO YOUR COMMON SENSE
Forget
not the first rule when you meet your counterpart – exchange your call card, it
determines the roadmap of your case.
In a
running down case, you act as defendant’s counsel. Case went on a full trial,
few witnesses were called after being short listed in a case management
proceedings. At the end of the case, parties were asked to submit. Being a
counsel for a long time and knowing the judge characters as fierce as roaring
lion in the cage, you found that your client was about to lose the case.
One
of the cardinal rule when doing the court’s case is to know the judge fully
inside out. You must know his characters especially on things he likes and
dislikes. Having said that, you also knew that the judge is a chain smoker. You
remembered one judge complaining about this judge that his chamber were smokey
due to the fact that his chamber locating next to this chain smoker judge.
Smoke got in the air con ventilator and reentered his chamber. He also
complained that his hair smell spice tobacco.
In
your case, you also know that judge will never tolerate hanky panky exercises
in court, he is a man of the book. I mean the law books. You knew that you are
going to lose your case and that suddenly snapped your not so common sense
thinking to figure out something workable. Remember the earlier statement? exchange your call card, it
determines the roadmap of your case.
Now,
you knew the judge well and you are about to lose your case. A good lawyer will
not say that he will think about it but must always be in a position to
say “ I have thought about it”
You
then quickly go to the nearby shop to buy a cartoon of Gudang Garam Surya and
ask for a gift wrap service as well. On top of the wrapper, you attached a
business card that belonged to the plaintiff lawyer. You have asked somebody to
hand it over to the judge secretary. The secretary then passed it to the judge.
The judge was very happy to get a cartoon of his favorite cigarette. He quickly
opened the wrap and was then so upset when looking at the call card that
belonged to the plaintiff lawyer stick nicely on the wrap. Realizing that the gift was
from the plaintiff lawyer, he smashed the whole cigarette into the dust bin.
The plaintiff lawyer has invited his wrath.
The
next day when the judge rise to deliver his judgment in the open court, he
stared fiercely to the young lady acting as the plaintiff lawyer without saying
a word. He then gave his decision in favor of the defendant by saying “ upon my
findings of facts which overweight the findings of laws , I hereby dismissed
the plaintiff claims and allow the defendant counterclaims”
Bravo
!! you won the case on human factors and weaknesses. Common sense does count.

SALAM LEBARAN 2014 - SELAMAT HARIRAYA, MAAF ZAHIR DAN BATIN
Kepada semua ex student dan kenalan,
Saya menyusun sepuluh jari mohon kemaafan di atas segala salah dan silap sepanjang perkenalan kita samada dalam kuliyah perundangan/ bengkel/seminar dan sebagainya. Muga tahun tahun yang mendatang akan lebih memperkasakan keimanan kita.
Janji Allah tetap benar, imbau kembali sejarah peperangan Badar, peperangan Ahzab, kehebatan tentera Salahuddin Al Ayubi yang berpuasa sepanjang berperang. Hari gembira untuk umat manusia............dunia ke arah keamanan dan kedamaian sejagat sepanjang 700 tahun mendatang sebelum kiamat. Tiada apa yang perlu ditakutkan..tiada apa yang perlu dibimbangkan.......marilah kita bersama sama bergembira,bersemangat menunggu masa dan saat itu.
MAS telah berada dalam "hot radar" Allah swt sejak akhir akhir ini. Siapakah yang bersalah??? Israel? Amerika ?? Ukraine atau Rusia??. Ada pula yang mengaitkannya dengan paspot Malaysia...Bagi mereka yang belum kenal siapa itu Allah dan sifat sifatnya.....akan tertutup pintu hatinya yang telah dipenuhi dengan jutaan bintik bintik hitam..maka mereka ini tidak nampak akan kekuasaan Allah di sebalik semua kejadian ini. Bukan Israil yang hilangkan MH370, bukan Amerika yang menyebabkan MH17 terhempas..semuanya berlaku dengan izin dan kehendak Allah juga. Kita sedang diuji tahap dan maqam keimanan kita.
Ada sesuatu yang Allah hendak sampaikan kepada DS Najib dan pimpinan tertinggi MAS. Muhasabahlah diri dan perbetulkan mana yang silap. Allah menegur kerana Ia sangat sayangkan Malaysia....yakinlah dengan penuh keimanan. terlalu banyak hikmahnya kejadian ini. Lapangkan dada, buka minda...dan belajarlah......"Learn a lesson......O ye who has vision to see"
Hariraya..hari untuk kita bergembira....hari untuk kita merayakan kebesaran Allah swt. Buangkan segala sifat mazmumah dan suburkan hati kita dengan sifat mahmudah...........sidiq amanah tabliq fatonah, adab tertib sopan santun marwah dan ikhlas.

GOOD & BAD MITIGATION IN THE TRAFFIC COURT
When you pleaded guilty before the Magistrate, you would be given a chance to say
something "appealing" to persuade the Magistrate to give a lighter fine.
BAD MITIGATION
Never ever giving the following reasons in mitigation
i. I am sole breadwinner
ii. I have a wife and kids to maintain
iii. I have an old parent to look after
iv. I am an odd jobs worker and has no steady income
v. or the likes

Reasons : The Judge would normally turn the whole things back to you and might simply say " you would not committed this offence if you have the heart of considering all these troubles that your family might suffer, it was you that never bother and symphatizing your family by committing this offence. And now you have the face of asking this honourable court to syphatize them, shame on you !
Instead, consider the following....
GOOD MITIGATION
i. This is my first offence, I repented and promise this honourable court that I will be more careful
next time
ii. i was in a rush to respond to the nature's call nearby, felt very sorry but I was left without a choice
iii. I was in the state of emergency sending the ill victim to nearby clinic
iv. I was chasing the snatch thief
v. In front me was a big tanker lorry, I could not see the traffic lights, I move as the lorry moves
vi. I could not see the traffic lights clearly because it was hidden by the tree branches
If the offence took place late midnight,
try the following:
Your Honor, it was late
at nite, no cars and other traffics around. It was between me alone and the
traffic lights. In such circumstances, I will have to seek redress of my own
judgments. At that time, I found that no cars coming from all angles and it was
safe for me to move on despite the red lights. Your Honor, the lights are just
mere prefix machines, it has no eyes and has no brain too. It blinks when the
time comes. But i am a reasonable human being capable of weighing the
circumstances at that nite. I leave it to your lordships whether to trust me or
to trust that bloody prefix machines which has no brain and eyes.
Your Honour, may I have
the privilege of a Cautioned and Discharged order

PENTINGNYA KEMAHIRAN MEDIASI KEPADA PEGAWAI PENGUATKUASA

Keadaan telah banyak berubah bila Kanun Tatacara Jenayah melalui proses pindaan yang cukup drastik dalam pengendalian kes kes jenayah di Malaysia semenjak tahun 2010. Kalau sebelum ini, kebanyakan proses penyelesaian kes dibuat secara tidak rasmi dan di peringkat jabatan sahaja tetapi berikutan dengan pindaan KTJ,ianya melibatkan mahkamah secara rasminya. Pindaan pindaan kepada KTJ menyaksikan perkenalan perkara perkara baru dalam pengendalian kes kes jenayah. Antaranya ialah konferen pra bicara (pretrial conference), pengurusan kes(case management), tawar menawar pengakuan (plea bargaining) dan lain lainnya. Kesemuanya ini memerlukan suatu kemahiran baru kepada pegawai penyiasat dan pegawai pendakwa dan kemahiran yang dimaksudkan itu ialah kemahiran mediasi iaitu suatu kemahiran yang bukan sahaja merangkumi kemahiran rundingan tetapi juga kemahiran menganalisa keperluan dan bukannya kehendak ( what you want may not necessary what you need) dan memahami keperluan pihak lawan secara objektif.
Sehubungan itu, terdapat satu kursus selama 2 hari yang akan diadakan di Universiti Malaya pada 5 dan 6 Jun 2014( Khamis dan Jumaat ). Ianya dikendalikan oleh pakar mediasi tempatan Cik Gunavathy Subramaniam dan saudara David Newton, seorang mediator antarabangsa dengan usaha sama Fakulti Undang Undang Universiti Malaya.
